Privacy Disclosure and Opt Out Notice

 

We at CD Federal Credit Union value the privacy of our members.  You have chosen to do business with us, and we recognize our responsibility to keep the information you provide to us secure and confidential.  We are committed to maintaining the confidentiality of information consistent with state and federal law.  This document is provided to explain our policy and your rights to you.

 

What This Policy Covers

This policy covers “non-public personal information,” which we call “personal information” in this policy.  This means personally identifiable financial information that we obtain about you in the course of providing services to you.  This policy does not cover information that is actually obtained from public sources such as county real property records or telephone directories.  In this policy, the term “member” refers to both current and former members, and also refers to joint owners of accounts and non-member obligors on loans.

 

Information We Collect About You

In the course of doing business, we collect and use various types of information, such as information available from public records and credit reports and information from your transactions with non-affiliated third parties, as well as information you provide to us.  We may also access information about you, such as credit reports, when considering a request from you for additional services or when exercising our rights under the law or any agreement with you.  In addition, we collect information about you from the following sources:

  • Information we receive from you on applications and other forms you submit to us, such as your name, address and social security number.

  • Information about your transactions with us, our affiliates (if any) or others, such as account balances and payment history.

  • Information we receive from consumer reporting agencies, such as your credit worthiness and credit history.

  • Information obtained when verifying the information you provide on an application or other forms; this may be obtained from your current or past employers, or from other institutions where you conduct financial transactions.

 

Information We Disclose

We may disclose, and reserve the right to disclose, all of the information that we collect, as described above.  However, at this time, we do not disclose any nonpublic personal information about our members or former members to anyone, except as permitted by law.

 

Categories of Non-Affiliated Third Parties to Whom We May Release Information to Conduct Our Business and as Required or Allowed By Law

We disclose personal information we collect as described above to non-affiliated third parties as necessary to conduct our business or to conduct your transactions, and as required or allowed by law.  Examples include, but are not limited to:

  • State and federal regulators, attorneys, accountants and other advisors,

  • Consumer reporting agencies,

  • Third parties involved in processing your Credit Union transactions such as financial institutions that process your checks, ACH transactions and ATM transactions,

  • Third parties who make lawful information requests on your account such as child support data matching programs

  • Third parties whose involvement in your transactions with us is necessary to meet our business needs, such as the Department of Motor Vehicles, companies that insure collateral you pledge as security for Credit Union loans, and debt collectors,

  • If you give us written permission.

 

Other Non-Affiliated Third Parties to Whom We Release Information

Service Providers

We may disclose personal information we collect as described above to third parties with which we have agreements to help us provide our products or services to you (called service providers).  We can disclose whatever information we collect about you to these third parties, although we generally limit the information we supply to what is necessary for the third parties to fulfill their agreements with us.  Before we disclose information to these third parties, they must agree in writing to keep your information confidential and use it only for purposes we authorize.  Examples of such third parties include:

  • A company with whom we have contracts to print and mail Credit Union statements,

  • A company with whom we have contracts to mail Credit Union pre-approved offers of credit.

 

Joint Marketing Partners

We may disclose information to third parties which we have agreements to jointly offer, endorse or sponsor a financial product or service (called joint marketing partners).  We can disclose whatever information we collect about you to these third parties, although we generally limit the information we supply to what is necessary for the third parties to fulfill their agreements with us.  Before we disclose information to these third parties, they must agree in writing to keep your information confidential and use it only for purposes we authorize.  Examples of such third parties include:

  • A company with whom we have a contract to jointly offer accidental death payment protection.

  • A company with whom we have a contract to jointly offer investment services.

 

Other Third Parties including Affiliates

We do not share personal information regarding our members with any affiliates, since we have none, nor do we share with third parties except as explained above.  If we enter into an agreement to promote the products or services of a third party who is not a joint marketing partner, we do so in such a way that we maintain control of member information.  The third party will receive non-public personal information about you only if you give us permission to release the information by requesting the product or service, or if you release the information directly to the third party when you become their customer.   When we share information with other parties for marketing purposes, you can expect them to treat it with the same strict standards as your credit union.

 

Termination of Membership

If you decide to terminate your membership with CD Federal Credit Union, we will not share information we have collected about you, except as may be permitted or required by law.

 

Our Protection of the Security of Your Information

Credit Union staff, management and volunteers are trained to keep member information strictly confidential.  When appropriate and necessary to protect your privacy, we require third parties to whom we release information to agree in writing to maintain appropriate physical, procedural and electronic safeguards to protect the information and to limit their use and disclosure of personal information to purposes that we authorize.  Within the Credit Union, we maintain physical, electronic and procedural safeguards that comply with federal regulations to guard your personal information.

 

Opt Out Rights

If you prefer that we not disclose nonpublic personal information about you to nonaffiliated third parties, you may opt out of those disclosures, that is, you may direct us not to make those disclosures (other than those permitted by law).  If you wish to opt out of disclosures to nonaffiliated third parties, you may fill out the form on this disclosure and return it to us, or simply call us at 925-825-0900. 

 

In the case of joint account holders, if any one of you exercises the right to opt out, we will treat it as if all of you directed us to not make disclosures to nonaffiliated third parties (except those that are permitted by law).

You have the right to control whether we share some of your personal information.  Please read the following information carefully before you make your choice below.

 

Your Rights

You have the following rights to restrict the sharing of personal and financial information with outside companies that we do business with.  Nothing in this form prohibits the sharing of information necessary for us to follow the law, as permitted by law, or to give you the best service on your accounts with us.  This includes sending you information about some other products and services.

 

Your Choices

Restrict Information Sharing With Other Companies We Do Business With To Provide Financial Products and Services:  Unless you say “No,” we may share personal and financial information about you with outside companies we contract with to provide financial products and services to you.

 

    • No, please do not share personal and financial information with outside companies you contract with to provide financial products and services.

 

Time Sensitive Reply

You may make your privacy choice at any time.  Your choice is kept on-file and will remain unless you state otherwise.  However, if we do not hear from you we may share some of your information with other companies with whom we have contracts to provide products and services.

 

To exercise your choice, a signed, complete response (which includes name, account number and date) should be returned to CD Federal Credit Union, 1855 Second Street, Concord, CA  94519.
